1. THE CLUB RULES
These club rules set out the
terms and conditions of membership and have been created to safeguard the use
and enjoyment of the Hobo Club by its members and their guests.
2. THE CLUB
The Hobo Club is a proprietary
private membership club based at 191 High Road Loughton. The Club reserves the
right to charge members a monthly subscription fee to the premises. The right
to amend or waive any such fees or subscriptions shall be in the Clubs sole
discretion.
3. CONFIDENTIALITY
The Hobo Club management and all staff members
adhere to the strictest confidentiality standards and pledge to maintain all
records and personal information concerning the members and their guests in the
strictest confidence.
4. RIGHTS AND PRIVILEGES OF MEMBERSHIP
A member shall be entitled to all the rights and
privileges of the Hobo Club and shall be bound by these rules but shall have no
proprietary rights in any of the premises or in respect of property of the
Club.
5. CANCELLING YOUR MEMBERSHIP APPLICATION
By submitting your application for membership, you
agree to be bound by these rules. You are free to withdraw your application at
any time prior to it being accepted. Following confirmation of your acceptance
as a member, you will have 14 days during which you may withdraw your
application without incurring any cost, after which time the first monthly
payment may be taken and will not be refundable. Should you wish to withdraw
your application, please contact the Membership Team at info@hoboclub.co.uk for
cancellation details.
6. MEMBERSHIP PAYMENT
Upon approval or renewal of your membership, your
membership fees become payable immediately. By providing us with your payment
details, you accept and consent to being charged with membership fees in the
form requested by the Hobo Club upon your application being approved or
renewed. It is within our discretion to amend our membership fees at any time,
and we will notify you in advance if there are to be any changes to the amount,
date or frequency of the payment of your membership fees. Failure to pay the
monthly subscription on the 25th will result in the member not being
admitted to the Club the following month and the membership being terminated.
7. MEMBERSHIP RENEWAL
Membership renews automatically on a monthly basis
though are reviewed by the Renewal Committee on a regular basis. Membership to
the club requires adherence to accepted standards of conduct and the rules of
the club. The decision of the Renewal Committee is final and without appeal,
and no reason will be given for refusal of a membership renewal at any stage.
You will be given minimum two weeks’ notice if your membership renewal is
accepted or declined.
9. MEMBERSHIP DATABASE
It is important for the Membership team to have
your current contact details, plus a photograph, in the membership database. If
your contact or payment details change, please let the Membership team know via
info@hoboclub.co.uk.
10. CHILDREN
The Hobo Club is designed for adults and operates a
strict over-18 policy. Guests may be asked for proof of age on arrival and
entry will be refused to any guest that, if requested, is unable to provide a
valid document confirming that they are older than 18 years of age.
11. ATTIRE
Whilst the Hobo Club does not dictate a strict
dress code policy, members should always be presentably dressed. Members are
also responsible for ensuring that their guests abide by this rule.
12. GUESTS
Hobo Club Members are permitted one guest in the Club
at a time accompanying the Member. A member’s guest may not enter any Club area
without that member present. Members may not be separated from their guests
within the Club or allow their guests to remain in the Club when they leave.
Members are responsible for ensuring their guests follow all club rules and can
face suspension or termination of their membership if their guests violate
those rules. Members may request to bring additional guests to The Hobo Club
and these requests will be at the sole discretion of management and the
Membership team.
13. MEMBERSHIP CARDS
All membership cards must be handed to the
reception of the Hobo Club to gain entry. Members should also expect to be
asked to present their membership card/app when they sit down to eat or drink
or if they open a bar tab. Where any member allows his or her card to be used
by a non-member, such non-member shall be denied access to, or removed from, the
Club and the member whose card was used may face suspension or termination of
their own membership. Please notify the Membership team immediately if your
membership card is lost or stolen.
14. PRIVACY FOR MEMBERS/GUESTS
Members and their guests must not approach, disturb
or solicit others with whom they are not personally acquainted. Doing so may
lead to suspension or termination of membership.
15. MOBILE PHONES
To protect the privacy of members and ensure a
relaxed atmosphere within The Hobo Club, members must be discrete whilst making
phone calls while in the Club. Texting is permitted. It is the member’s
responsibility to familiarise their guests with the phone policy.
16. CAMERAS/RECORDING DEVICES
No cameras, video or recording devices may be used
while in the Hobo Club. Members are responsible for ensuring their guests also
abide by this rule. The Hobo Club reserves the right to take possession of and
confiscate any camera, video or recording device and any photos, videos or
other recorded images used or taken while on the premises.
17. AUDIO/VIDEO SOUND
Movies, videos, songs, webinars and presentations
must only be played through headphones and should not be audible to any other
member or guest present.
18. PRESS & SOCIAL MEDIA
The Hobo Club has a strict no press policy. Members
will be held accountable if they or their guests disclose or identify any other
members or guests who are in The Club in any press or social media including
Facebook, Twitter, Instagram, TikTok and personal blogs. Similarly, members and
their guests must refrain from identifying or describing any private hire or
member event occurring at the Hobo Club.
19. ACCIDENTS AND INJURIES
Members must report any accident or injury they or
their guests may have whilst on the premises as soon as possible to a member of
management and in any event within 24 hours of the incident. This information
is needed in order to comply with health and safety obligations and for
insurance purposes.
20. ILLEGAL SUBSTANCES
No member or guest of a member shall use, ingest,
purchase, possess or distribute illegal drugs while on the Clubs premises (or
attempt to do any of the same). If any of the above prove true, the membership
in question will be terminated.
21. BILLS
All bills must be settled in full before leaving the
Hobo Club. There are no credit facilities. Members are responsible for their
guests’ bills if they are not paid.
22. SMOKING POLICY
No smoking or vaping is permitted inside the Hobo
Club at any time.
23. FOOD & BEVERAGES
Please refrain from bringing in any outside food or
beverages, unless medically necessary.
24. LEAVING THE CLUB
All members and their guests are asked to respect
our nearby residents by being quiet when leaving The Hobo Club premises or
while in the surrounding area.
25. ANIMALS
No animals will be allowed in the Hobo Club except
for assistance dogs.
26. DISCIPLINARY PROCEDURE
Conduct that is prejudicial to the reputation and
character of The Hobo Club may result in suspension or expulsion of a member.
Such conduct may include improper, violent or abusive behaviour, the
communication of information concerning the club affairs or members or their
guests to the media, a serious or repeated failure by a member (or any of their
guests) to abide by the standards of conduct and the rules of the Club, misuse
by a member of their card, or the provision by a member of materially false or misleading
information when applying for membership.
An expelled member will have their membership terminated and may not return to
the Club as a guest or reapply to become a member. A refund of the expelled
member’s subscription will be at the discretion of The Hobo Club. Any member or
members who remove, damage or destroy any property belonging to The Hobo Club
or to members or to guests on the premises will be liable for the full
replacement cost and to expulsion. Every member binds him/herself to abide by
the rules, bylaws and regulations of The Hobo Club upon acceptance as a member.
If the Proprietor considers that the conduct of any member (or his or her
guests) either inside or outside of the premises is, at its sole discretion,
contrary to the interests of The Hobo Club or the Proprietor, the Proprietor
may expel the member and their guests from The Hobo Club premises and/or
suspend or terminate that member’s membership.
27. CONSTITUTION
The Hobo Club is constituted to
encourage non-political, business, social and recreational activities.
28. LIABILITY OF THE PROPRIETOR
The Proprietor shall not be liable to any member or their guests for any loss,
damage or injury suffered by them or to their property in excess of the
membership fees paid by such member. The Proprietor shall not be liable to any
member or their guests for any indirect or consequential losses. However, this
does not exclude or limit in any way the Proprietor’s liability where it would
be unlawful to do so, and which includes liability for death or personal injury
caused by the Proprietor’s negligence (or the negligence of the Proprietor’s
employees, agents or subcontractors) and for fraud or fraudulent
misrepresentation.
29. INTERPRETATION OF THE RULES
In the event of any dispute
arising as to the meaning or interpretation of these rules, the matter shall be
referred to the Renewal Committee, whose decision shall be final.
These rules shall be governed and construed in accordance with English law and
you agree to submit to the exclusive jurisdiction of the courts of England.
30. AMENDMENTS TO THE RULES OF THE CLUB
The Proprietor may change the
rules of the Club by displaying notification of the change on the club’s
premises for a period of 7 days. A copy of these rules will be made available
to all members upon reasonable notice.
